How Are My Workers’ Comp Benefits Determined?
The amount of your weekly income benefit is typically determined by looking at your earnings for the 13 weeks immediately prior to the accident date. Georgia workers’ compensation law has a cap on the maximum amount of weekly benefit that can be received. For accidents occurring on or after July 1, 2015, the maximum amount is $550. The maximum time period for which an injured worker can receive weekly income benefits for noncatastrophic injuries is 350 or 400 weeks, depending on the facts of the case.
For catastrophic injury cases, an injured worker may receive weekly income benefits up to the age of 65 and in some cases for life. Under Georgia workers’ compensation law, catastrophic injuries include spinal cord injuries with severe paralysis, amputations of arms or legs, severe brain injury, severe burn injuries, blindness, and the inability to perform previous work and any other work available in substantial numbers in the national economy.
